A MEETING OF THE OGLESBY CITY COUNCIL WAS HELD ON TUESDAY, SEPTEMBER 4, 2012, AT CITY HALL. THE MEETING WAS CALLED TO ORDER AT 7:00 P.M.

A MOTION WAS MADE BY PORTER, SECONDED BY RIVARA to accept Ordinance No. 808-090412, an ordinance authorizing an opportunity to settle pursuant to the provisions of Illinois Supreme Court Rule 574. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY DANEKAS, SECONDED BY RIVARA to withdraw the current wage and salary ordinance for the Oglesby Ambulance. AYES: PORTER, DANEKAS, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY DANEKAS, SECONDED BY RIVARA to place a new wage and salary ordinance for the Oglesby Ambulance on file. Mayor Finley explained that he felt the new ordinance was a compromise. Commissioner Porter read from a prepared statement before the vote. Porter said that it “should surprise no one” that he opposed the ordinance. He said that he felt the ordinance “contains confusing language and doesn’t clearly spell out its intent.” Porter also said that he felt the council was “attempting to exercise ‘administrative control’ over (his) department. He shared a letter with the council from Attorney Stewart Diamond, who specializes in municipal law. He said that Diamond shared his belief that “some members of this council participated in meetings that were designed to exclude (him) from conversations that involved ‘adminstrative control’ of (his) departments.” He said that he had attempted to discreetly address those issues with the mayor before the meeting, but that the mayor had not been available “all weekend long,” so that he was forced to speak out. He noted that he, Attorney Andreoni and the mayor would be meeting after the council meeting. AYES: DANEKAS, RIVARA, MAYOR FINLEY. NAYS: PORTER, YBORRA. MOTION CARRIED.

A MOTION WAS MADE BY PORTER, SECONDED BY RIVARA to place an ordinance providing for the impoundment and towing of vehicles used in the commission of certain offenses within the city of Oglesby. Attorney Andreoni explained that the state had recently expanded the list of offenses for which vehicles could be impounded. This ordinance sets the procedure for impoundment and for owners to contest the action. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY RIVARA, SECONDED BY PORTER to approve a request from Holy Family School to close roads and provide traffic control and first-aid for a race on Oct. 6, 2012. Porter said before voting that his departments would incur about $800 in additional expenses resulting from the race. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY YBORRA, SECONDED BY PORTER to approve a request from LP Foundation to host a tag day on April 13, 2013, from 8 a.m. to noon. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY RIVARA AND SECONDED BY PORTER to approve a request from IVCC Men’s Basketball team to host a tag day on Sept. 15, 2012, from 8 a.m. to noon with the stipulation that those collecting funds be 18 years old and older. AYES: DANEKAS, PORTER, RIVARA, MAYOR FINLEY. NAYS: YBORRA. MOTION CARRIED.

The Mayor then opened the floor for public comments:
• Resident and Oglesby Municipal band member Wanda Lent thanked the city for their continued support of the band.
• Resident Drew Merriman again pressed the council to look beyond the ambulance department when cutting costs.
• Resident Vern Siemers asked the council to address a situation in the 300 block of East Walnut. Siemers said the home “was getting to be a dump” and asked the city to “clean it up.”

Commissioners’/Mayor Reports
None of the commissioners had anything to report, while Mayor Finley reminded residents of the upcoming Harvest Fest and Dueling Pianos.

A MOTION WAS MADE BY PORTER, SECONDED BY RIVARA to table Ordinance No. 808-080612, an ordinance authorizing an opportunity to settle pursuant to the provisions of Illinois Supreme Court Rule 574.  City Attorney James Andreoni asked that this ordinance continue to be tabled until he hears from the State’s Attorney’s office.  Andreoni said he believed that the ordinance would be able to be voted on at the next meeting. AYES:  DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY.  MOTION CARRIED.

 

Mayor Finley then read a letter from the Oglesby Ambulance Board outlining their support for the proposed ordinance and their suggestions for improvement.  The board recommended passing the proposed ordinance and “work on amending a few issues.”  The board suggested: 1. Hiring an assistant to work no more than 1500 hours a year; 2. Implement an internship program; 3. Pay $2.35 per hour for call out hours; 4. Hire 2 paramedics and 2 EMTs, preferable local people.

 

A MOTION WAS MADE BY RIVARA, SECONDED BY PORTER to place the letter from the Oglesby Ambulance Board on file.  AYES:  PORTER, DANEKAS, RIVARA, YBORRA, MAYOR FINLEY.  MOTION CARRIED.

 

A MOTION WAS MADE BY DANEKAS, SECONDED BY PORTER to table the Oglesby Ambulance Wage and Salary ordinance, pending modifications in light of ongoing negotiations between Commissioners Danekas and Porter.  AYES:  PORTER, DANEKAS, RIVARA, YBORRA, MAYOR FINLEY.  MOTION CARRIED.


A MOTION WAS MADE BY DANEKAS, SECONDED BY PORTER to approve the request from the Oglesby Knights of Columbus to hold its annual Tootsie Roll drive on Saturday, September 22. AYES:  DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY.  MOTION CARRIED.

 

The Mayor then opened the floor for public comments:

·        Resident Drew Merriman encouraged the commissioners to “go after all the other departments,” when looking for ways to cut costs.


Commissioners’/Mayor Reports

            Commissioner Rivara talked about ongoing ways his department is cutting costs and increasing revenues.

 

            Commissioner Yborra said Fischer Excavating will be reseeding the berms after Labor Day.  He also said that the city had treated the catch basins for mosquitoes, noting the recent reports of West Nile virus in the state.

 

            Mayor Finley announced that the playground at McPhedren Park had been installed.  He said the park would be 95 percent completed by the end of August.  He also reminded residents of the upcoming Harvest Fest and Scarecrow Scramble on October 6.
