A MEETING OF THE OGLESBY CITY COUNCIL WAS HELD ON MONDAY, SEPTEMBER 17, 2012, AT CITY HALL. THE MEETING WAS CALLED TO ORDER AT 7:00 P.M.

A MOTION WAS MADE BY DANEKAS, SECONDED BY RIVARA to accept Ordinance No. 810-091712, an ordinance addressing the wage and salaries of the Oglesby Ambulance Service director and employees. AYES: DANEKAS, RIVARA, MAYOR FINLEY. NAYS: PORTER, YBORRA. MOTION CARRIED.

A MOTION WAS MADE BY PORTER, SECONDED BY RIVARA to accept Ordinance No. 811-091712; providing for the impoundment and towing or vehicles used in certain offenses within the City of Oglesby. Attorney Andreoni said that the city will need to hire a hearing officer, most likely Doug Karmarsic, and will split the cost with LaSalle once they pass their own ordinance. AYES: PORTER, DANEKAS, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY RIVARA, SECONDED BY YBORRA to accept a recommendation from the Zoning Board of Appeals to require notification of all property owners within 100 feet of the property sought to be rezoned. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY RIVARA, SECONDED BY YBORRA to accept Ordinance No. 812-091712, which amends Chapter 17.76, Rezones and Variances. The ordinance puts the burden of identifying those property owners within 100 feet of a property that is to be rezoned on the person seeking the variance. Andreoni said that while the state does not require notification, most communities do “provide for some limited notification.” Commissioner Yborra questioned the inclusion of schools as parties to be notified, and Andreoni explained that members of the zoning board felt strongly about notifying schools. Commissioner Danekas was reassured by Andreoni that the cost of notification would be borne by the petitioner. Andreoni said a new form would need to be created. He also said it was the petitioner’s responsibility to ensure that all property owners were listed and notified. “The city won’t be checking,” he said. But cautioned that any action could be overturned if all affected property owners were not notified. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY DANEKAS, SECONDED BY PORTER to place the State Sales Tax Allotment of $25,384.58 on file. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY YBORRA, SECONDED BY RIVARA to place the Motor Fuel Tax Allotment of $8,088.78 on file. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY PORTER, SECONDED BY RIVARA to approve a request from Bob Steele and the Starved Rock Runners to hold the annual Turkey Trot on Thanksgiving morning. The council also okayed the request to close certain streets and provide traffic control. AYES: DANEKAS, PORTER, RIVARA, YBORRA, MAYOR FINLEY. MOTION CARRIED.

A MOTION WAS MADE BY YBORRA AND SECONDED BY PORTER to approve a request from Cub and Boy Scouts to sell popcorn from Sept. 23 through Oct. 21. AYES: DANEKAS, PORTER, RIVARA, MAYOR FINLEY. NAYS: YBORRA. MOTION CARRIED.

A MOTION WAS MADE BY PORTER, SECONDED BY YBORRA to table a request by Dylan Torres to hold a musical festival in Le High Park, July 12-13 from 8 a.m. to 11 p.m. each day. Mayor Finley said he had talked with Torres before the meeting and explained to him that the city’s special event liquor licenses were limited to non-for-profit organizations. AYES: DANEKAS, PORTER, RIVARA, MAYOR FINLEY. NAYS: YBORRA. MOTION CARRIED.

A MOTION WAS MADE BY YBORRA, SECONDED BY PORTER to donate $200 to the Illinois Valley Chapter of the American Red Cross. AYES: DANEKAS, PORTER, RIVARA, MAYOR FINLEY. NAYS: YBORRA. MOTION CARRIED.

The Mayor then opened the floor for public comments:
• Resident Drew Merriman asked the council to consider enacting an ordinance banning the burning of leaves and yard waste.
• Jack Ferrari questioned the council on why some neighborhoods in the city didn’t have sidewalks, saying that it was a safety issue. Ferrari wanted the council to require those properties without sidewalks to install one. Commissioner Yborra explained that the city couldn’t go back and require sidewalks in neighborhoods that previous councils had approved without sidewalks. Yborra also noted that since he had been on the council, every development was required to include sidewalks.

Commissioners’/Mayor Reports
Commissioner Rivara said the city had withdrawn its request to annex property near IVCC. Rivara sought the property so that the city could purchase a power line from Ameren. Announced that the electric department would be working on a project to provide additional power to the waste water treatment plant. He expected the work to take 6 months.

Commissioner Yborra thanked those residents that participated in the EPA sampling and noted that information regarding the leaf vac would be in the October utility bills.

Commissioner Porter reminded residents that another electronic recycling event would be held Saturday, October 6th, from 9 a.m. to 1 p.m. in the parking lot next to Lehigh Park.

Mayor Finley announced that there would be a working meeting at 5:30 p.m. Monday, Oct. 1, to discuss the electrical rate study. He also updated the council on McPhedren Park, which is near completion.
