 A MEETING OF THE OGLESBY CITY COUNCIL WAS HELD ON MONDAY, JUNE 4, 2012, AT CITY HALL.  THE MEETING WAS CALLED TO ORDER AT 7 P.M.

PRESENT:  COMMISSIONERS DANEKAS, PORTER, RIVARA, YBORRA, ATTORNEY JAMES ANDREONI, CITY CLERK BECKY CLINARD.

ABSENT:  MAYOR FINLEY

A MOTION WAS MADE BY PORTER, SECONDED BY RIVARA to approve the regular meeting minutes from May 21, 2012.  AYES:  DANEKAS, PORTER, RIVARA, YBORRA. MOTION CARRIED.

A MOTION WAS MADE BY RIVARA, SECONDED BY YBORRA to accept Ordinance No. 804-060412, which accepts an agreement with Buzzi Unicem on work that was completed recently.  Attorney Andreoni said that the agreement makes it clear that they city still own the lines and part of the transformer involved in the recent changes and grants the city a easement in order to continuing maintaining the system. AYES:  PORTER, DANEKAS, RIVARA, YBORRA. MOTION CARRIED.

MOTION MADE BY YBORRA, SECONDED BY PORTER  to accept the Illinois Department of Transportation Audit Report which showed that the city’s records that pertain to the motor fuel tax monies are correct and in agreement with the state’s.  AYES:  PORTER, DANEKAS, RIVARA, YBORRA. MOTION CARRIED.

MOTION MADE BY YBORRA, SECONDED BY PORTER to place on file the Plan Commission’s letter regarding the annexation request by David and Debbie Ernat.  Attorney Andreoni explained that the Ernats must now formally file an annexation request with the city.  Andreoni said the Plan Commission “didn’t see a problem” with the Ernats’ request to access the parcel from the city’s right of way at the end of Hickory Avenue.  He did note, however, that he believed it was important that the Ernats be aware of – and that the minutes of the meeting show – that the city’s easement would revert back to the developer’s trust if the road had not been built within 50 years.  He said the title to the land “did not pass” until the road was built. AYES:  PORTER, DANEKAS, RIVARA, YBORRA. MOTION CARRIED.

MOTION MADE BY YBORRA, SECONDED BY PORTER to place Attorney Andreoni’s May 25th letter that accompanied the Ernat letter on file as well. AYES:  PORTER, DANEKAS, RIVARA, YBORRA. MOTION CARRIED.

Commissioner/Mayor Reports:

Commissioner Rivara warned citizens about a scam that encourages residents to switch electric providers.  He also said that a question had come up recently about what happened to the scrap wire that was being removed during road reconstruction.  Rivara said his department cashed the scrap in recently and deposited $500 with the city clerk’s office.

Commissioner Porter noted that the city attorney was looking into video gaming and would be prepared to discuss it at the next meeting.

Commisisoner Danekas announced a meeting of the Zoning Board of Appeals on June 19th at 6 p.m. regarding a variance request by Timothy J. Ajster.
